Pets from a banned account remain on a banned account since often they are the result of cheating and won't be put into the system.
However Staff does occasionally take the pets of a banned account from the showroom and put them on the profile to naturally die and lose their names, so names being held by these accounts can be put back into circulation.
Unfortunately, Staff doesn't do this regularly as it's a time-consuming process. It could take quite a while for the pet to be put on the banned user's profile to die. But eventually it will happen and you'll have a chance to snatch the name.
